Sale General Conditions

This general conditions
 are applied to all sales operation of Net Market Srls which is considered the seller as indicated in the previous lines.

 

1. Acceptance of sale conditions

When the customer makes an order according to established procedure, he/she declares that he/she completely accepts the general conditions of sale and payment.

 

2. Prices and Acceptance of Orders

All the prices of the website include VAT.
The seller reserves the right to modify prices in every moment, without any notice.

Sale contract is regulated by Italian law and by the general conditions explained in the following lines. The contract fulfilled between Net Market Srls and the Customer terminates with acceptance of goods payment by the seller.

Acceptance is implicit, or it can be communicated to the Customer in any way.
The seller reserves itself the right to refuse customer’s order if there are not the best supply conditions, by refunding any received amount.

 

3.Payment Conditions

Accepted payment methods are:

Credit Card: this payment method enables you to use credit card in order to buy safely.

  • Payment by Paypal
  • Postepay
  • Cash on delivery (+ € 4,99)

 

 

4.Shipping

We would ask you to provide a delivery address where there is always someone who can collect the goods.

Delivery times: in Italy delivery time is 48-72 hours (working days), since we receive the order, carried out by Brt or Access Point Ups carrier.

Delivery costs: shipping costs change according to the total weight of the products in Italy, including islands.span><

Cost until 2kg changes between €7,50 and €7,99 euro according to the choice of the carrier, cash on delivery is forecast exclusively for shipping by Bartolini and €4,99 will be added to the total amount of the order.

Shipping within Europe will be carried out through Ups Access Point and Ups Standard, the cost will be between €16,90 and €30,90 according to the country.

5.Orders

Shopfarma24.com will send an email to the Customer mailbox to confirm the reception of the order, after the order fulfillment.

We advise the consumer to print the email and to keep it.

If the consumer will not receive it, he/she should contact ShopFarma24.

6.Transport

Transport service through BRT and UPS ACCESS POINT carrier offered by Shopfarma24 should be considered a Customer facility.

The Customer is responsible for the goods who are sent.

The seller will never be considered responsible for deterioration, loss, delays, penalties or other prejudices and damages which will occur during the transport.

Transport costs will be communicated by the seller in writing.

The transport is carried out by the carriers until they arrive, dumping, placements, upstairs deliveries and assemblies are excluded.

 

7.Right to withdrawal

Online sale is compared to email-order sale. The right to withdrawal enables the customer to give back the product on order if he/she decides to change idea about the purchase.

According to the D.Lgs. 6 settembre 2005 n. 206, the consumer has the right to withdrawal from the sale contract because of any reason, without giving explanations and without any penalties.

The right to withdrawal has to be used within 15 days since the goods delivery, by communicating the decision through registered post addressed to: NET MARKET SRLS - Via Bianche 23, Carrè 36010 (we certify the postmark).

Within 15 days, it will be possible to send a withdrawal communication by email addressed to commerciale@shopfarma24.

Failing which, this communication has to be confirmed by registered post within the following 48 hours.

The withdrawal communication has to include: product information related to the right to withdrawal; order number with purchase confirmation; customer information (name and surname/business name, address, telephone, email); bank code (Bank, bank account holder, IBAN) for the return of the purchase amount.

Goods have to be returned to Net Market Srls in perfect conditions. The products do not have to be washed or damaged.

The returned products have to be delivered to the carrier for the return within 15 days since delivery date.

The goods have to be returned to Net Market Srls with one shipping.

Net Market Srls reserves the right not to accept items of the same order returned and sent in different moments.

After receiving returned goods and checking that all requirements are satisfied, it will send to the customer an email to confirm returned goods reception.

Within 15 days since goods delivery, Net Market Srls will fulfill the credit corresponding to the returned goods price.

This amount will not include shipping costs incurred by the customer for the return.

 

8. Guarantee

All products have a 12 month conventional guarantee for manufacturing defects, according to D.Lgs. n. 24/02.

In order to use guarantee assistance, the Customer will have to keep the invoice (or the transport document) received with the products.

The methods of guarantee service will be communicated to the Customer by the Seller after the complaint.

However the guarantee is provided nearby seller headquarters where the products, charged to the customer, have to be sent.

 

9. Customer rights to the received goods

The buyer has to check the delivered product and to lodge a complaint against the carrier, noting detailed reservation on the carrier bill if the product is different or damaged.

If the customer decides to reject carrier deliveries regarding damaged packaging, he/she will have to inform immediately within 24 hours since the event.
After this term, the products are considered accepted and corresponding to what was ordered, except for the right to guarantee explained in the point n.8.

 

10. Undelivered Goods

The Customer can ask us to be advised about the delivery.

If the carrier cannot deliver the goods because of the Customer (for example, unknown receiver, absent receiver, goods refusal, deviation of the goods, etc.), the costs about stock opening are charged.

 

11. Personal data treatment and issues

Personal data requested during the order are used on storage devices in order to satisfy obligations of the contract fulfilled with the Customer and they will not be transferred to external users.

The customer has always the right to annul personal data consent through a written communication sent to seller headquarters.

The Customer, who through the purchase declares that he/she has received the report according to art. 13 regarding his/her right, according to art. 7 D.Lgs. n. 196/2003, has the right to access to personal data according to the forecast procedures.

Sale contract is considered concluded and regulated by Italian law.

IThis contract is regulated by Italian law. If the user is the consumer, he/she has to refer to the court of his/her town, if it is in Italy. Regarding other type of issues, the law court of Vicenza will be competent.
